TERMS OF SERVICE H2O Pools Effective Date: April 29, 2026

1. Overview These Terms of Service govern your use of H2O Pools' services, website, and any agreements entered into between H2O Pools and its clients. By engaging our services, you agree to the terms outlined below.

2. Services H2O Pools provides custom pool design, construction, renovation, patio and concrete work, and outdoor living enhancements. All services are outlined in a written proposal or contract provided to the client prior to the start of any project.

3. Estimates & Proposals All estimates provided by H2O Pools are based on the scope of work discussed at the time of consultation. Final pricing may vary if the scope of work changes, unforeseen site conditions arise, or the client requests additional services. Any changes will be communicated and agreed upon in writing before proceeding.

4. Payment Terms

A deposit is required before any work begins

Payment schedules will be outlined in your project contract

Final payment is due upon project completion

H2O Pools reserves the right to pause or stop work if payments are not made according to the agreed schedule

5. Project Timeline H2O Pools will provide an estimated project timeline at the start of each project. Timelines may be affected by weather conditions, permit approvals, material availability, or other circumstances beyond our control. H2O Pools will communicate any delays promptly.

6. Permits & Approvals H2O Pools will assist in obtaining necessary permits required for construction. The client is responsible for ensuring their property complies with all local HOA rules, zoning requirements, and regulations. Delays caused by permit processing are not the responsibility of H2O Pools.

7. Client Responsibilities The client agrees to:

Provide accurate property information and site access

Communicate any known underground utilities or obstructions

Make timely decisions and approvals to keep the project on schedule

Ensure payments are made according to the agreed schedule

8. Warranty H2O Pools stands behind the quality of our work. We offer a workmanship warranty on all completed projects as outlined in your project contract. Warranty does not cover damage caused by misuse, neglect, acts of nature, or unauthorized modifications.

9. Limitation of Liability H2O Pools shall not be held liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability shall not exceed the total amount paid by the client for the specific project in question.

10. Cancellations If a client wishes to cancel a project after work has begun, they are responsible for all costs incurred up to the point of cancellation including materials, labor, and permit fees. Deposit payments are non-refundable once work has commenced.

11. Dispute Resolution In the event of a dispute, both parties agree to first attempt resolution through good faith negotiation. If a resolution cannot be reached, disputes will be handled through mediation or arbitration in accordance with applicable local laws.

12. Changes to These Terms H2O Pools reserves the right to update these Terms of Service at any time. Clients will be notified of any significant changes that may affect active projects or agreements.
